Dispute Resolution Procedures

This graphic describes the steps families can take if they have concerns about their child’s special education services. It starts with informal actions, such as talking to the teacher, principal, or special education director. If the concern is not resolved, families can consider formal dispute resolution options. These options include: Mediation: A voluntary and private process with a neutral third party. Administrative complaint: A written complaint submitted to the state. Due process hearing: A formal legal process with a hearing officer. The graphic encourages families to try resolving concerns at the local level first. It also provides contact information for The Arc Tennessee, the Family Engagement in Special Education team, and the Tennessee Department of Education. Links to resources and forms for each dispute resolution method are included.
